Rules of purchase - sale of goods in the online store tequilaonline.lt

1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter referred to as "Rules"), upon their approval by the Buyer (after familiarizing themselves with the Rules and ticking the box next to the statement "I agree with the terms and conditions of purchase"), are a binding legal document for the parties, which determine the rights and obligations of the Buyer and the Seller for the purchase of goods , terms of payment for them, order of delivery and return of goods, responsibility of the parties and other provisions related to the purchase and sale of goods in the tequilaonline.lt online store.
1.2. The Seller reserves the right to change, amend or supplement the Rules at any time.
1.3. Buy at tequilaonline.lt able-bodied natural persons, at least 20 years old, legal entities have the right to use the e-shop.
1.4. By placing an order, the Buyer unconditionally confirms that he has the right to buy in the tequilaonline.lt e-store.

2. Protection of personal data
2.1. tequilaonline.lt has the right to collect and process personal data provided by the Buyer to tequilaonline.lt when purchasing goods, and, if necessary, to disclose them to third parties when it is necessary for order fulfillment, data processing or tequilaonline.lt activity planning and analysis. Data about Buyers and visitors of the online store are protected against loss, unauthorized use and alteration. Data carriers are fully protected against access by third parties.

3. Entry into force of the purchase-sale agreement
3.1. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart, clicks on the "Buy" link.
3.2. tequilaonline.lt is not obliged to separately notify the Buyer of its agreement to enter into a contract. It is considered that tequilaonline.lt confirms the order from the moment it starts executing it.

4. Abandonment of the contract. Exchange and return of goods
4.1. The buyer has the right to refuse the contract of purchase and sale of goods concluded with the tequilaonline.lt online store by notifying the Seller by e-mail, indicating the desired return of the product and its order number no later than 14 (fourteen) days from the day of delivery of the product, except in cases, when one of the Civil Code 6.228 Art . 10 was drawn up . The contracts listed in part 2 , namely the right to withdraw from the contract, are not valid:
- contracts for perishable goods or goods with a short shelf life;
- contracts for packaged goods that have been unpacked after delivery and are unsuitable for return due to health protection or hygiene reasons;
4.2. The Buyer notifies the Seller of the cancellation of the distance contract: a) by submitting a duly completed model contract cancellation form. This form is approved by the Government of the Republic of Lithuania or its authorized institution; or (b) by providing a clear statement setting out the decision to withdraw from the contract.
4.3. The goods can be returned after agreeing in advance the time and address of the collection of the goods, or by delivering the goods to the physical store of tequilaonline.lt in Vilnius, Pylimo st. 58. For the return of goods, contact tequilaonline.lt by means of communication indicated in the Contacts section of the e-shop.
4.4. After receiving the Buyer's request, the Seller sends a confirmation or informs in another way about the receipt of the message. If the purchased item is of poor quality, the item may be replaced or returned to the Seller at the Buyer's request.
4.5. The Buyer can use the provided right to return goods only if the goods have not been damaged or have not substantially lost their merchandise appearance (unremoved and undamaged labels, protective films, etc.), unused. If the product is not fully assembled, is damaged, messy or not properly packed, tequilaonline.lt has the right not to accept the product and not to return the money paid by the Buyer for the product.
4.6. The direct costs of returning the goods are paid by the Buyer.
4.7. The money to pay for the goods accepted by the Buyer, but later refused, is paid to the Buyer's account no later than within 14 (fourteen) calendar days from the date of receipt of the Buyer's notice of withdrawal from the Agreement, unless the Seller and the Buyer agree otherwise. Refunds are not issued until the Buyer has returned the goods.
4.8. When returning high-quality goods that meet the Buyer's order, the Buyer will be refunded the delivery fee he paid for the goods, except if not all the goods purchased by the Buyer during the same purchase are returned.

 

5. Obligations of the buyer
5.1. The buyer must accept the goods in accordance with the procedure established by these Rules and pay the agreed amount for them.
5.2. If the data provided in the Buyer's contact form changes, he must immediately inform the seller through the specified contacts.
5.3. The buyer, using the tequilaonline.lt online store, undertakes to comply with these Rules and not to violate the legal acts of the Republic of Lithuania.
5.5. If the Buyer, during the delivery of the goods, refuses to accept the goods without good reasons, the Buyer must cover the costs of the delivery of the goods.

6. Seller's Rights
6.1. If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration.
6.2. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
6.3. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer, having chosen the delivery method "Collection in store", does not collect the goods (and/or does not pay) within 3 (three) working days.
6.4. When the Buyer chooses the payment method "Cash on delivery" in cash during the delivery of the goods, he agrees to pay a fee of EUR 2.00 for this service.
6.5. tequilaonline.lt has the right to refuse the concluded Purchase-Sale Agreement if the stock of the goods specified in the agreement has run out, as well as if the agreement was concluded by a person who, based on these Rules, did not have the right to conclude the agreement.

7. Obligations of the seller
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the online store tequilaonline.lt under the conditions set out in these Rules and the online store. provided services.
7.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
7.3. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if prepayment was made.
7.4. The Seller undertakes to respect the Buyer's privacy right to personal information belonging to him, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.

8. Product prices, payment procedure and terms
8.1. The prices of goods in the online store and in the formed order are indicated in euros with VAT. tequilaonline.lt reserves the right to change product prices in the event of changes in tax rates.
8.2. The buyer pays for the goods in one of the following ways:
8.3. Payment is an advance payment when the Buyer settles using: a) electronic banking through the Paysera electronic payment platform. 8.3.1 Payment in cash at the time of delivery of the goods - The Buyer pays EUR 2.00 for the goods and the cash collection service fee at the time of their delivery (handover - acceptance). If the order amount is in cents, the total purchase amount is rounded to the nearest whole number based on mathematical rounding (ie cents up to 49 cents are rounded down and cents above 50 cents are rounded up).
8.3.2. The maximum value of the order when paying in cash at the time of delivery is 500 euros.
8.4. When paying by the payment method provided in point 8.3.1, the Buyer undertakes to pay immediately.

9. Delivery of goods
9.1. The goods are delivered by the Seller or his authorized representative.
9.2. The seller undertakes to deliver the goods to the buyer within 1-3 working days. This term does not apply in cases where the necessary goods are not in the Seller's warehouse or the goods are pre-traded. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to Force Majeure circumstances.
9.3. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
9.4. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
9.4.1. The buyer must guarantee the age of the host (at least 20 years old).
9.5. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. If the buyer signs the invoice (bill of lading) or other document of shipment transfer - acceptance, it is considered that the shipment has been delivered in a suitable condition.
9.6. Delivery fee and more detailed information:
9.6.1. Delivery of goods in Lithuania (except the Curonian Spit) is free if the order is over 50 euros.
9.6.2. Delivery of goods in Lithuania (except the Curonian Spit) is paid if the order size is 1-49 EUR - 5 EUR per shipment.
9.6.3. On the eve of the delivery of the goods, you will receive an SMS message from the courier about the delivery of the package, and on the day of delivery, the courier will contact you about the exact delivery time.

9.7. In the event that the Buyer, on the basis of these Rules, refuses the purchase-sale contract, he is obliged to pay all the direct costs of returning the goods to the Seller. The amount of these costs of the Seller is deducted from the money paid for the goods to be returned to the Buyer.
9.8. If it is not possible to deliver the ordered goods in one shipment, then tequilaonline.lt has the right to deliver the goods in several shipments.
9.9. Ordered goods can be picked up free of charge at the Tequila Embassy store: Pylimo st. 58, Vilnius (according to a separate agreement).
9.10. In all cases, the Seller is released from responsibility for the violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.

10. Product quality guarantee and expiration date
10.1. The characteristics of each product sold by tequilaonline.lt are generally indicated in the product description attached to each product.
10.2 The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the display used by the Buyer.
10.3. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
10.4. The Seller undertakes to sell the goods to the Buyer in such a way that he is given a real opportunity to use such goods until the expiration date. In the case of particularly short warranty periods, the goods in the online store are marked with a special warning sign or sold on the condition that the ordered goods will be picked up in the store.
10.5. Goods that have a manufacturing defect can be returned, but on the condition that the Buyer returns such goods to the Seller within 3 working days. If the seller recognizes that the product has a manufacturing defect, the product can be exchanged for the same or similar product.

11. Liability
11.1. The buyer is fully responsible for the correctness of the data provided in the contact form. If the Buyer does not provide accurate data, the Seller is not responsible for the resulting consequences. The buyer in the tequilaonline.lt online store, by filling out the contact form, confirms that he is at least 20 years old and assumes all possible losses related to disputing this fact and the consequences arising from it.
11.2. The buyer is responsible for the actions taken while using this online store.
11.3. The buyer is responsible for the transfer of his contact data to third parties. If the services provided by tequilaonline.lt are used by a third person who has connected to the online store using the Buyer's contact data, the Seller considers this person to be the Buyer.
11.4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
11.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise, control those websites and does not represent those companies and individuals.
11.6. In the event of damage, the guilty party compensates the other party for direct losses.

12. Exchange of information
12.1. The Seller sends all notifications to the e-mail address provided in the Buyer's contact form.
12.2. The Buyer sends all messages and questions by means of communication specified in the "Contacts" section of the Seller's online store.

13. Final Provisions
13.1. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
13.2. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
